Terms & Conditions
In Michigan, massage therapy is a licensed healthcare profession governed by the Michigan Public Health Code and the Bureau of Professional Licensing (LARA). To protect both yourself and your license, it is important to clearly outline the legal boundaries of a professional session.
The following draft is designed to be firm yet professional, ensuring clients understand that "professional time" is synonymous with "clinical boundaries."
Professional Standards & Safety Agreement
To maintain the therapeutic integrity of our sessions and comply with Michigan Public Health Code (Part 179A), all clients must adhere to the following professional standards.
1. Draping Requirements
Michigan law and professional ethics mandate that appropriate draping must be used at all times during a massage therapy session.
-
The Policy: All clients will be draped with a top sheet and/or blanket. Only the specific area of the body being worked on will be undraped.
-
Mandatory Coverage: In accordance with standard professional practice, the gluteal cleft (buttocks) and genitalia must remain covered at all times for all clients. For female-identifying clients, the breasts must also remain fully covered.
-
Refusal of Draping: Clients may not opt out of draping. If a client refuses to remain under the drape or intentionally removes the drape, the session will be terminated immediately.
2. Zero Tolerance for Inappropriate Behavior
Massage therapy is a clinical, therapeutic service. Any illicit, suggestive, or sexual behavior—whether verbal or physical—is a violation of the law and professional boundaries.
-
Inappropriate Conduct: This includes, but is not limited to, suggestive comments, jokes of a sexual nature, inappropriate touch toward the therapist, or requests for services outside the scope of practice for a Michigan Licensed Massage Therapist (LMT).
-
Immediate Termination: If at any point the therapist feels unsafe or the client’s behavior becomes inappropriate, the session will be terminated immediately.
3. Consequences & Fees
-
Payment: In the event of a session termination due to inappropriate behavior or a violation of draping policies, the client remains responsible for the full cost of the scheduled block of time. No refunds will be issued.
-
Reporting: Under Michigan law, sexual misconduct in a professional healthcare setting can be reported to local law enforcement. I reserve the right to ban any client from future bookings and report incidents to the appropriate authorities if necessary.
Client Acknowledgment
By booking an appointment, you acknowledge that you have read and agree to these terms. You understand that you are paying for a professional "block of time" and that this time is strictly therapeutic in nature.
What to include in the T&C document
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
